These terms and conditions do not affect your statutory rights

Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through the web site.

We may modify these terms at any time. We will post the modified terms on the web site. The modified terms will come into effect as soon as they are posted on the web site and use of the web site (or of any services provided through the web site) after that point will be subject to the modified terms.

Payment:

Payment can be made for photographic prints, canvas prints or paintings online through our payment provider or via cheque made payable to "The Big Art Company". We will not accept cash payments. Receipt of your payment will be provided and full payment for your artwork is required before we dispatch any goods. We do not provide any credit terms and all prices quoted to you and displayed on the site will include VAT (17.5%).

Delivery:

Delivery costs will vary depending on the final size and destination of the artwork. This cost will be made clear before you are asked for any payment. Delivery will be provided for by specialist couriers and they may require for someone to be present to sign and collect the artwork. It is the sole responsibilty of the customer to ensure that someone is available to take delivery and Paintings From Photos cannot be held responsible for any event caused by a delivery not being met.

Returns:

Paintings From Photos will accept returns of paintings only if they are damaged when delivered. We will not accept returns without prior agreement. On receipt of the returned item Paintings From Photos will fully refund all cleared payments and reimburse all delivery charges or repair/repaint the damaged artwork. Prints on canvas due to their unique nature can only be returned if they have been damaged in transit. A new print will be created and delivered within 14 days. Photographic prints may also only be returned if damaged or faulty. These will then be replaced by new prints.

Copyright:

It is the sole responsibility of the hosted photographer to ensure that any image that they present for transformation into an artwork are copyright free or that the copyright is owned by the photographer themselves. By supplying Paintings from Photos with your own images you allow Paintings From Photos to display and use these images in any appropriate manner to market them. You further agree to allow these images to be sold as photographic prints, prints on canvas or paintings. Paintings From Photos will take no responsibility for any breach of copyright caused through painting or printing an image supplied by a customer. As the photographer you will retain full copyright of your images whilst they are hosted with Paintings From Photos. You can remove any photo from your gallery at any time by using the account area. Once a photo is removed from your account we delete all stored versions of the image.

Printing Services:

We currently provide several printing services for photographers. The materials we use for these prints have been tested to ensure a good balance between the highest quality, durability and affordability for our customers. For our canvas prints we use Epson 9600 printers, Ultrachrome Inks and bespoke stretchers. For our photographic prints we use FujiFilm Frontier 370 and 390 printers printing onto FujiFilm Crystal Archive photographic paper. By placing your photos for sale on the site you are agreeing for us to use these printing techniques and materials to reproduce your artwork.

Photo Details:

Any text that is added as a description, title or keywords to a photo is deemed as copyright free and as the photographer you grant us license to alter any of these sections as we see fit for the purpose of clarity and accuracy.

Privacy Policy:

Whilst Paintings from Photos will need to take certain personal details such as contact and delivery information we will never pass this information over to any 3rd party (except for the needs of product delivery and payment processing). All personal information will be kept in a secure environment and not be accessible via the internet.

Cookies:

Our site uses cookies to remember images you have seen and to process our checkout. We do not store any information about you with these cookies and they are only there to make your browsing experience more enjoyable.

Links:

This site contains links to other sites. We cannot be responsible for the privacy policies and practices of other web sites. We recommend that you check the policy of each site that you visit.

Soliciting:

You agree not to use the site to solicit customers to buy and sell your work outside of the Paintings From Photos website. Contact emails, addresses or website address will be deleted from any text and repeated infrigment will lead to having yourself banned from the site.

Linking:

What you cannot do:

You are not allowed to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in the web site.

You are not allowed to upload, email to us or order prints of any images or other material which contain:

pornographic or obscene material - we do have an erotica category on the site and any postings to this area must involve models over the age of 18 at the time of photo being taken, not show subjects in a sexually aroused state or depict explicitly sexual behaviour;
racist material;
material that is likely to incite hatred against any person or group;
blasphemous material;
defamatory or otherwise actionable material;
images of any criminal act;
material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party;
material that breaches any applicable laws or legislation

Law and jurisdiction

These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with English law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the English courts will have exclusive jurisdiction over such dispute.
